The Right to Disconnect: What it means for small business owners

The boundaries between work and personal life are becoming increasingly blurred. Many Australian workers are expected to stay connected and responsive long after their official working hours have ended. But the "Right to Disconnect", new legislation set to take effect for large employers on August 26, 2024, will likely change that. As a small business owner, it's important to understand what this law means for you and your employees. The Right to Disconnect, introduced under the Fair Work Amendment Bill 2024, gives employees the legal right to switch off from work-related communications outside their usual hours. In other words, unless there's an urgent need, employees are no longer required to answer emails, calls, or messages once they've clocked off.

With over 6254 requests for assistance from the Ombudsman in 2023-24, up 10 per cent from the previous year, there are growing concerns from businesses either owed money by potentially insolvent companies or facing challenges in meeting their own financial obligations.
